Ground Tec Equipment Privacy Policy – Privacy Act 1988

Reitara Pty Ltd trading as Ground Tec Equipment Equipment (“Ground Tec Equipment”) is committed to protecting your privacy and the confidentiality of your personal information.

 

We are bound by the Privacy Act 1988 (Commonwealth) as amended, and the principles set out in that Act, and accordingly we must have a privacy policy explaining how we manage personal information.

This privacy policy describes the kinds of personal information we collect and hold; how we go about collecting that information; and why we do so.  It also outlines how a person may access information about themselves or seek correction of that information, and how an individual may complain about a breach of an Australian Privacy Principle.

 

By purchasing goods from Ground Tec Equipment, communicating with Ground Tec Equipment through email, by telephone, or in writing you agree to the use and disclosure of your personal information in the manner described in this policy.


When and how do we collect information?

Ground Tec Equipment collects the personal information needed to provide services to you and for our business operations.  If you choose not to provide certain personal information to us we may not be able to provide you with the services you require.

The following are the main types of personal information collected by Ground Tec Equipment and the main purposes for which they are collected.

From you

We collect information from you when:

  • you apply for a credit account; and / or
  • you purchase goods from us; and / or
  • you communicate with us in person or over the telephone, send us a letter, fax or an e-mail; and / or

  • when considering an application by you for a credit account
  • when taking steps to deal with an overdue payment owed by you
  • when checking employee work history

The third parties we collect information from include credit reporting agencies, other creditors referred to in credit reports or in an application for a credit account, and your nominated referees.

What information do we collect?

Personal information

The type of personal information that Ground Tec Equipment may collect from individuals will depend upon the particular transaction and the dealing.  Typically the personal information collected by Ground Tec Equipment may include an individual’s:

  • name, title, street and postal address(es)
  • date of birth
  • financial details including banking details
  • telephone number(s)
  • email address(es)
  • records of communications with Ground Tec Equipment
  • credit card information

Sensitive information

Primary purpose

Personal information will, generally, only be used for the primary purposes of:

  • when you submit an application for credit to us, and we provide a credit account to you, to administer the account
  • servicing our business relationship with you
  • processing transactions and sending related communications
  • to identify you and verify your identity
  • responding to individual’s queries

Other purposes

We also use information that we collect for the following additional ancillary purposes:

  • for internal accounting and administration
  • for regulatory compliance
  • to protect us from error or fraud
  • to help us identify and inform you about other products or services that might benefit you

Government related identifies

Other than Australian Business Numbers, we do not collect or use government related identifiers, such as Medicare or tax file numbers.  We only collect tax file numbers when an individual commences employment with Ground Tec Equipment, and it is only used for lawful purposes.

Direct marketing

From time to time, we may use the personal information collected from you to identify products and services which may benefit or interest you.  We may contact you by telephone, email or post to let you know about those products or services.

When do we disclose personal information?

We keep your personal information confidential

We keep your personal information including your name and account details confidential except:

  • when the law requires us to disclose the information, such as to a law enforcement body or a court under a subpoena
  • when disclosure is in the public interest, such as to disclose a suspected or actual crime or misdeed
  • when it is in our interest, such as in relation to legal action to which we are a party
  • with your consent 

Your consent

Your consent can be:

  • Given expressly, either verbally or in writing.  For example, when you submit an account application you give your express consent for us to obtain a credit report about you from a credit reporting agency.
  • Implied consent arises where consent may reasonably be inferred in the circumstances from the conduct of the individual.  For example, if you attach a page of references with your account application or job application with Ground Tec Equipment, it is implied that you give consent for Ground Tec Equipment to contact your references.  A reasonable person would understand that the very nature of providing references implies that consent is given to contact them. 

Who we disclose personal information to and why

We may disclose your personal information to any organisation that we deal with in the ordinary course of business including the Australian Federal Government, State and Territory Governments, financial institutions, postal, freight and courier service providers and external business advisers (eg. company accountant, debt collection agency, and lawyer).

We disclose information to credit reporting agencies with your consent.  We do this so that we can assess your application for a credit account.

We will not disclose your names, address and contact details to third parties for the purpose of direct marketing unless you have consented to this.

Where you have consented, we disclose your information to our partners.  For example, if you have purchased a product in conjunction with another service provided to you by a partner, we may disclose information to the partner so the partner can provide services to you.

In essence, Ground Tec Equipment will not disclose personal information to anyone outside the business unless the individual concerned has given their consent, or disclosure is otherwise permitted by the Australian Privacy Principles.  Exceptions to these principles include disclosure being necessary to prevent a serious threat to a person’s life, health or safety, or for law enforcement purposes.

Giving information to third parties

Sometimes, we give your personal information to service providers contracted by us so that they can help us provide services to you.  The service providers are contracted to fulfil a specific function and we only disclose such personal information to them as is necessary to fulfil that function.

Our services providers must comply with the Privacy Act 1988 (Commonwealth) in the management of your personal information.

Cross border disclosure of personal information

It is our current policy not to disclose personal information to third parties located overseas.  If we change our policy at some time in the future, we will comply with the requirements of the Privacy Act 1988 (Commonwealth) that apply to cross border disclosures of personal information and this Privacy Policy will be amended accordingly.

Disclose of not reasonably identifiable and de-identified personal information

When you are not reasonably identifiable in relation to the information collected from or about you, we may use that information for any purpose or share it with third parties.  We may also de-identify the information we collect about you so that we can use and disclose it without using or revealing any personal information about you.


How do you access, update and correct information?

Accessing your information

You can request access to the information we hold about you.  The time it takes for us to respond to your request depends on the type and quantity of information you wish to access.  We will contact you within three working days of your request to advise you of our estimated response time.

The law may prevent us from disclosing certain information to you.  If this is the case, we will advise you at the time of your request.

Costs to access your information

There is no charge to make a request for access to your personal information.  Ground Tec Equipment will charge a fee to provide that information as is our right under the Privacy Act 1988 (Commonwealth).  Cost is available on application.

Keeping your information up-to-date

If any of your personal information changes, please contact us to update it so that we can continue to provide you with the best possible service.  We will take reasonable steps to ensure your information is accurate, complete and up-to-date whenever we collect or use it.

Correcting your information

If you find that the information about you that we hold is inaccurate, incomplete or out-of-date, please contact us and we will correct it.

Ground Tec Equipment will use reasonable endeavours to comply with an individual’s request to correct their personal information.   If Ground Tec Equipment disagrees with any request to correct an individual’s personal information, and the individual requests that Ground Tec Equipment include in the record of their personal information a statement that they have a contrary view, Ground Tec Equipment will use reasonable steps to do so.

Ground Tec Equipment allows individuals the option not to identify themselves when dealing with us, where practicable.


How do we keep your information secure?

Ground Tec Equipment uses commercially reasonable administrative, technical, personnel and physical measures to safeguard information in our possession against loss, theft and unauthorised use, disclosure or modification.   However, no one can guarantee the complete safety of your information.

Only authorised users can access your personal information, and access is only for approved purposes.

Your personal information may be stored in hardcopy documents, as electronic data, or in our software or systems.

We maintain physical security over our paper and electronic data stores and premises, such as locks and security systems.  We also maintain computer and network security through the use of such tools as firewalls, user identifiers and passwords to control access to computer systems.


Complaints

If you believe that the privacy of your personal information has been compromised, you are entitled to complain.  We will respond to your complaint as soon as possible but within three working days, to let you know who is responsible for managing your complaint.  We will try to resolve the complaint within 10 working days.  When this is not possible, we will contact you within that time to let you know how long we estimate it will take to resolve the complaint.

How to make a complaint
